Our Process
At The Miller Elder Law Firm, we understand whether you are in crisis or in need of future long-term care planning, the process can seem overwhelming. Our team works tirelessly to guide, plan, and simplify every step of the legal process combining extensive experience and knowledge of the law with genuine compassion for our clients.
EVERY CLIENT, FAMILY, AND CASE IS UNIQUE
We understand that every family is different and every legal situation is unique, so we work with you to create a plan that protects you while giving you independence and peace of mind. Your journey with us starts with an intake call where we get to know you and your situation, answering any questions you have. From there, our team will direct you on the next steps with Shannon, Genna , or one of our associate attorneys. They will also guide you to valuable resources, like our YouTube channel, where you can learn as much as possible about what to expect moving forward.
Our team is on the lookout and ready to act on emergency situations, like emergency temporary guardianships and exploitation injunctions.
During the initial call, we will properly vet your circumstances which usually allows us to quote a proper fee for service via a phone call, Zoom meeting, or face-to-face appointment. Sometimes we draft a retainer agreement and send a questionnaire for that client’s specific process.
In most circumstances, we will have you fill out a questionnaire and provide an introductory packet that details key steps of the entire process, introduces you to the team members you will be working with, and gives you general information about our firm.
Some situations offer maintenance-type programs where you maintain continued access to an elder care coordinator or ongoing long-term attorney services. Know that our team will work with you to create the exact plan needed to assist with your situation.
“Whatever your questions are, we’re going to take the time during that initial conference call to address any concerns or questions that you might have.”
HOW LONG WILL THIS PROCESS TAKE?
Depending on the issue you and your family are facing, the length of service will vary. For guardianships, an emergency guardianship can happen in a week or two. A full guardianship process can take up to 3 months, even 9-18 if it involves probate. Litigation processes vary tremendously, with some litigation matters turnaround within 30 days while others can take two to four years. Probate and trust ligation cases can also take an extended amount of time to get through the discovery process and go to trial. Medicaid planning can be simple and quick depending on what assets exist and what we need to shift around or retitle in order to get you qualified. Typically these cases are fast and can wrap up within 2 months depending on the circumstance.
Client cooperation is key as getting requested items to us and maintaining consistent communication will ensure each process moves quickly. The Miller Elder Law Firm’s team of skilled and caring experts are on hand to help things stay on track, make sure your questions are answered, and work to ensure you are heard, protected and confident in your retirement and end of life plan.
