“It used to be that for veterans benefits, to receive aid and attendance and those kinds of things, the VA would not consider transfers like Medicaid does in the Medicaid context. There is pending legislation, though, that would require that the VA ask about transfers of items for less than market value, and they would consider imposing a penalty period. That’s not a law yet, but it’s in the works, and it looks like that’s the way that the federal legislation is going to go.”
